ARTICLE 1: PURPOSE

The objective of Cigar Control is to provide users with useful tools for the personal tasting of their cigars. These Terms apply to all registrations and all orders placed on the Website, governing the contract between Giulio Mollica (hereinafter referred to as Cigar Control) and any person who registers or places an order on the Website (hereinafter referred to as the User). Registration and any orders on the website can only be made by private users, it is not possible to purchase the service for resale to third parties. By registering for the service or placing an order on the Website, the User accepts all the terms of the general conditions. Users who decide not to accept the general conditions will not be able to register or place an order on the Website. The general conditions may be modified at any time by Cigar Control. These changes will not apply to orders currently being processed but only to all new orders placed on the Website. The User is therefore invited to carefully review the general conditions before registering or placing an order on the website. ARTICLE 2: SERVICE FEATURES

The service consists of a free component and an optional paid "Premium" component. The premium service has a variable duration depending on the user's choice at the time of ordering. With the free component, it is possible to enter up to a maximum of 3 cigar tastings.

ARTICLE 3: TERMS AND CONDITIONS OF PARTICIPATION

Registration on the website and the use of Cigar Control Services require a minimum age of 18 years and full legal capacity. Cigar Control does not provide professional services and does not guarantee the accuracy and completeness of the information made available in the texts, nor does it provide any guarantee regarding the results of its tastings or any consequences of using the offered services.

ARTICLE 4: PREMIUM SERVICE ORDERING PROCEDURE

The User who wishes to purchase the premium service must follow the following procedure: register on the website (this procedure is free and has no cost), and if they decide to purchase the "Premium" version, they must complete the payment information and validate their order after verifying it. All orders placed on the Website must be paid online by credit card or via PayPal.

ARTICLE 5: PRICES AND PAYMENT METHODS

The prices of the products offered on the Website are in euros, including VAT. The prices are calculated based on the User's order and are communicated to them before the order is confirmed. Cigar Control reserves the right to change prices at any time, with the understanding that the price published on the Website on the day of the order will be the only price applicable to the User. To pay for their order, the User has at their disposal all the payment methods offered at the time of the final order validation, namely: Credit card, PayPal. The credit card payment procedure will take place through PayPal on secure servers; no payment data (credit card numbers) will be recorded or stored by Cigar Control.

ARTICLE 6: SERVICE ACTIVATION AND RENEWAL

The activation of the "Premium" service will occur upon payment confirmation. The renewal of premium programs is not automatic; 15 days before the expiration of the premium program, the user will be invited to renew the service. If the program is not renewed by making a new payment, the service will no longer be usable, not even in free view.

ARTICLE 7: RIGHT OF WITHDRAWAL

The User has a maximum of 14 (fourteen) days pursuant to Art. 64 of the Consumer Code from the activation of the "Premium" service to exercise their right of withdrawal without providing any explanation or paying any penalties. If the maximum time to exercise this right expires on a holiday, it is automatically extended until the next working day. The User must contact us at the email address info@cigar-control.com. In the event of exercising the right of withdrawal, Cigar Control will make every effort to reimburse the User within a maximum of 14 days from the date of receipt of the request. The User will be reimbursed by re-crediting the credit card used for the service payment. If the withdrawal is communicated beyond the already mentioned period of 14 (fourteen) days from the activation date, the service cannot be refunded.

ARTICLE 8: WARRANTY AND LIABILITY

Cigar Control's liability can only be invoked within the scope of the legal warranty owed to the User concerning the conformity of the service. The use and/or purchase of the service are the exclusive responsibility of the User. Cigar Control cannot be held responsible for direct or indirect damages caused by the use of the service. Cigar Control provides the User with no additional guarantees beyond those required by law and those expressly stated in the general conditions. Cigar Control's liability cannot be invoked in cases of force majeure or fortuitous events, that is, in cases of unforeseeable events and/or circumstances beyond the control of the Parties. Cigar Control is not responsible in the event of technical problems due to force majeure that limit the use of the service (accidental damage to hardware components, data loss caused by system errors, network failure).

ARTICLE 9: DATA PROTECTION

By registering for the Cigar Control service, the user gives consent to the processing of the data entered by Giulio Mollica. The data will be processed through IT procedures and stored in our systems. The data provided will be used exclusively for the proper use of the service and will not be shared with third parties. At any time, you can consult, request modification, or deletion of the entered data by contacting us at info@cigar-control.com.

ARTICLE 10: INTELLECTUAL PROPERTY

All elements of the Website (videos, images, texts, audio, and graphics) are subject to intellectual property rights owned by Cigar Control. Any reproduction, exploitation, dissemination, and/or use of the Website's elements, whether textual, IT, visual, or auditory, is strictly prohibited, and in the event of violation, civil and criminal penalties provided by law will apply to the violators.

ARTICLE 11: APPLICABLE LAW

In case of disputes, the applicable legislation is Italian law.
